LEGAL TERMS, PRIVACY POLICY, AND USER CONTENT AGREEMENT

and all services, memberships, programs, and events operated by Robbie Hancock, Sync or Swim Music, Sync Music Pro, and Emotive Music.


1. TERMS OF USE AGREEMENT

1.1 Acceptance of Terms

By accessing or using any of our websites, programs, memberships, services, events, or content, you agree to these Terms of Use. If you do not agree, do not use the Services.

1.2 Services Covered

These Terms apply to all Services we provide, including:
Websites, member portals, online content
Sync or Swim Music Membership
Sync Music Pro All Access Program
SWARC challenges and AHOD listening sessions
Pitch to Pro sessions
Masterclasses, workshops, and online conferences
1:1 mentoring, coaching, consulting
Recording, mixing, mastering, and production services
Music supervision and film scoring
Acuity scheduling
Zoom sessions, events, and recordings
Private and public Facebook groups and communities

1.3 Eligibility

Users must:
Be at least 18 years old
Provide accurate information
Have legal rights to any content they upload
Follow all applicable laws
Abide by community rules and guidelines

We may deny access at our discretion.


2. USER RESPONSIBILITIES

Users agree to:
Use Services for lawful purposes only
Not share confidential or member-only materials outside the community
Not misrepresent identity or credentials
Not harass, abuse, or disrupt others
Not share Zoom links, recordings, or member access without permission
Not upload illegal, infringing, harmful, or unauthorized materials
Not copy, scrape, or replicate website content
Not misuse pitch sessions or access to industry pros


3. PAYMENTS, SUBSCRIPTIONS, AND REFUNDS

All fees are listed in CAD unless stated otherwise.

Current pricing:
Consulting: $175 CAD per hour
Sync or Swim Music Membership: $249 CAD per year
Sync Music Pro All Access: $999 CAD per year or $99 per month

Subscriptions renew automatically unless cancelled before the renewal date.

Refund Policy:
Due to the digital nature of the content and immediate access to intellectual property, recordings, and private community spaces, all sales are final and non-refundable.

Chargebacks or disputes may result in permanent removal from all Services.

We may update pricing at any time.


4. INTELLECTUAL PROPERTY RIGHTS

All content is the exclusive property of:
Robbie Hancock
Sync or Swim Music
Sync Music Pro
Emotive Music

Protected materials include:
Videos, masterclasses, replays
Music, recordings, production work
Conference sessions, interviews
Course materials, written guides, documents
Logos, branding, trademarks
Private community posts
Zoom sessions, event replays
Training and instructional content

Users may not copy, sell, publish, distribute, reproduce, or share any content without written permission.

Recordings of Zoom sessions or events may not be shared, uploaded, or distributed.


5. NO GUARANTEE OF RESULTS

Participation in programs, consulting, membership, or education does not guarantee:
Music placements
Sync deals
Income
Library acceptances
Industry responses
Professional outcomes

All results depend on individual skill, consistency, and effort.

We provide education, strategy, and professional guidance but do not promise specific outcomes.


6. DISCLAIMERS

Services are provided “as is.”

We are not responsible for:
Third-party platforms (Zoom, Disco, Facebook, Mailchimp, Acuity)
Technical issues or outages
Loss of user data
Actions or opinions of industry pros
User interpretations of guidance
Errors, omissions, or delays
Unauthorized access due to user negligence


7. COMMUNITY GUIDELINES

To maintain a safe, inclusive atmosphere, users must adhere to:
No bullying, harassment, hate speech, or abuse
No spamming or unapproved self-promotion
No sharing confidential member content
No recording sessions (unless explicitly permitted)
No sharing screenshots, Zoom links, or private materials
No violating NDAs or confidentiality rules

Violations may result in permanent removal from all platforms without refund.


8. RECORDED SESSIONS AND CONSENT

Participation in Zoom sessions, live events, masterclasses, or calls may be recorded for:
Replays
Internal archives
Member access
Quality assurance

By attending, you consent to recording.
Recordings are not to be shared publicly unless we explicitly authorize it.


9. LIMITATION OF LIABILITY

To the fullest extent allowed by law, we are not liable for:
Indirect or consequential damages
Lost revenue or business interruption
Decisions made based on consulting or training
Data loss or technical failures
Actions taken by third-party pros or platforms

Total liability will not exceed the amount paid for the specific service involved.


10. TERMINATION

We may suspend or terminate access for:
Violations of these Terms
Harassment or abusive conduct
Sharing unauthorized content
Chargebacks or fraud
Disruptive behavior toward community, staff, or pros

No refunds will be issued for termination due to misconduct.


11. THIRD-PARTY LINKS AND SERVICES

Our Services integrate with platforms such as:
Disco
Acuity Scheduling
Zoom
Mailchimp
Facebook
Instagram
YouTube
TikTok

We are not responsible for any policies, failures, or outages of these platforms.

Users must review their separate terms.


12. GOVERNING LAW

These Terms are governed by the laws of British Columbia, Canada.
Any dispute must be handled exclusively in British Columbia courts.


13. MODIFICATIONS

We may update or revise this document at any time.
Continued use of the Services constitutes acceptance of the updated version.


14. PRIVACY POLICY

This Privacy Policy explains what information we collect, how we use it, and your rights as a user.

14.1 Information We Collect

We may collect:
Name, email, address, and contact info
Payment information (processed securely by third-party providers)
Music submissions, links, cues, and files you provide
Zoom sessions, chats, and shared materials

Content uploaded to membership groups or forms

To provide, operate, and improve our Services
To communicate with you
To process payments
To manage memberships and subscriptions

To protect our platforms against abuse

We do not sell your information.

14.3 Data Protection

We use commercially reasonable technical and administrative safeguards.

Third-party processors such as Stripe, PayPal, Zoom, Acuity, and Mailchimp maintain their own data protections.

We may use cookies and analytics tools to improve site functionality and measure performance.

14.5 Your Rights

Users may request:

15. USER CONTENT AGREEMENT

By submitting music, links, files, questions, or materials to any of our Services, you agree:

You own all rights to your submitted content
You grant us permission to use your submissions for:
Pitch sessions
Live feedback
Workshops
Zoom recordings
Replays for paying members
Display during educational events
Internal training and operations

We do not claim ownership of your music.

You agree and understand that:
Industry pros may provide guidance that is their opinion only
We are not responsible for lost opportunities or feedback disagreements
We may store your submissions for archival or administrative purposes

You consent to the display of your name, music, and submission links during events or recordings when you voluntarily submit them.
